Access Agreement and Legal Terms & Conditions

Entire agreement
This is the entire agreement between Esequiturs ("Provider") and you ("Reder") (the "Parties"). If any part of this agreement is found invalid, the remaining provisions of this agreement shall remain in force.

Reder agrees to the following Terms & Conditions:

Satire
E*sequiturs is a work of educational satirical commentary about human knowledge created by Provider. E*sequiturs thus quotes and links to third party content for educational, satirical and commentary purposes. Provider bears no responsibility whatsoever for any quoted or linked content.

Fair use of third party content; images
E*sequiturs quotes copyrighted third party content (in 50 words or less per citation in fair use). Provider bears no responsibility whatsoever for third party content, changes to third party content or Reder's use of such content. Wikipedia content may be bound by the terms of the Wikipedia GNU Free Documentation License. Links to third party content are provided in cases of direct quotation.

Provider has received permission (or permission is pending) to use certain third party images, which have been modified. Provider bears no responsibility whatsoever for such images; Reder may not reproduce any such images for any reason.

Names
Any similarity between anyone living or dead or the names of anyone living or dead and any fictional characters or names used in e*sequiturs is purely coincidental.

Copyright and trademark
E*sequiturs is copyrighted under United States and international copyright laws, with notice as follows:

In advance of formal trademarking, e*sequiturs is a common-law trademark in international use as of October 28, 2008.

Changes to content; no refunds; errors & omissions; link modifications
As a dynamic work, e*sequiturs is subject to change without notice. No payment will be refunded for any reason, including an incompatible or outdated browser. E*sequiturs may contain errors, and there may be omissions, which may (without notice) or may not be corrected at the Provider's sole discretion. Broken or dead links may (without notice) or may not be repaired at the Provider's sole discretion; repairs, if any, may not be made in a timely fashion, if ever. Changes to, and/or addition or deletion of links may be made without notice at the Provider's sole discretion.

Access; Deposting
As a work that exists only on the Internet, e*sequiturs is subject to Internet "uptime"; e*sequiturs bears no responsibility whatsoever for Internet availability or access. The e*sequiturs website may be periodically shut down for maintenance or other reasons without notice. E*sequiturs may be temporarily or permanently deposted without notice; if so, no refunds will be provided.

IMPORTANT: No access to third parties; revocation of access
Reder agrees not to make e*sequiturs available to any third party by any means, including, but not limited to, providing password or other access information, or providing an electronic or physical copy of any part or all of e*sequiturs. Reder understands and agrees that Reder's access may be permanently revoked automatically and without notice if two or more parties attempt simultaneous access to e*sequiturs using Reder's password or other access information.

Subscription access
The e*sequiturs e-commerce transaction confers subscription access that is unilaterally revokable by Provider without notice. The e-commerce transaction is neither a transfer of tangible physical property nor a service of any kind, and is therefore non-taxable.

Governing law
This agreement shall be governed by and construed in accordance with the laws of the State of Connecticut, United States of America, without regard to its conflicts of laws or provisions. Any judicial action or proceeding between the Parties relating to this Agreement shall be brought only in the courts of the State of [adult content] Connecticut and the United States District Courts for Connecticut. Each Party consents to the jurisdiction of such courts, agrees to accept service of process by mail, and hereby waives all jurisdictional and venue defenses otherwise available to it.

ADULT CONTENT WARNING AND AFFIDAVIT E*sequiturs contains, and links to, adult content. By accessing e*sequiturs, Reder avers that he or she is 18 years of age or older.

By obtaining access to e*sequiturs, Reder accepts and agrees to these Terms & Conditions, and agrees to be legally bound by them.
